Florida's construction-industry exemption is available to:
- Sole proprietors with an active Florida contractor license
- Partners in a construction business
- LLC members of a construction company
- Corporate officers of a construction corporation
The key requirement is an active Florida contractor's license — without it, you cannot file. The exemption is also limited to the construction industry. Non-construction trades generally cannot file under the standard DFS process.
How the Florida DFS Filing Process Works
Florida WC exemptions are filed through the Florida Division of Financial Services (DFS) online portal. Here's the basic process:
- Log in to the DFS portal at myfloridacfo.com
- Complete the application with your license number, Federal EIN, and business registration information
- Pay the $50 state filing fee
- Submit and track status
Most exemptions are issued within 1–3 business days of a complete, accurate submission. The certificate is issued electronically and immediately usable on job sites and for general contractor verification.
The 2-Year Renewal Cycle
Florida exemptions expire two years from the date of issuance — not from a calendar date. The expiration is printed on your certificate.
Many contractors miss this because:

- They assume the certificate is permanent
- They only check when a GC asks for proof

3. More than three corporate officers listed

4. EIN issues
A mismatched or unverified Federal EIN will stall the application. Make sure your EIN matches the registered business entity exactly.
Does Your Florida Exemption Cover Other States?
No. A Florida Certificate of Election to be Exempt is valid only for work performed in Florida. If you cross state lines for work, you need either:
- A separate exemption in that state (where available), or
- Workers' compensation coverage for out-of-state work

What Happens If You're Injured While Exempt?
A WC exemption removes you from the workers' compensation system. If you're injured while working:
- You cannot file a WC claim (you elected out)
- Medical bills are your responsibility unless you have private health insurance or an occupational accident policy

- The business name on the certificate matches what's in your sub agreement
